How do public tenders work in Ukraine?

Ukrainian public buyers, from ministries and municipalities to state-owned and utility companies, publish their tenders in Prozorro, the central electronic procurement system, which bidders access through accredited e-marketplaces. Ukraine is not an EU member, so tenders do not appear in TED. During martial law most procurement follows the Peculiarities of Cabinet of Ministers Resolution No. 1178 on top of Law No. 922-VIII.

Law and buyers

The legal basis is the Law of Ukraine "On Public Procurement" (Про публічні закупівлі) No. 922-VIII of 2015. Since 2022 most procurement runs under the martial-law Peculiarities (Особливості) adopted by Cabinet of Ministers Resolution No. 1178 of 12 October 2022, which apply during martial law and for 90 days after it ends. A new Law No. 4888-IX of 27 May 2026 is in force; its localisation rules apply from 24 August 2026 and the rest from 24 March 2027, when Law 922-VIII lapses. The Ministry of Economy and Environment (Мінекономіки) is the authorised body for procurement policy. Buyers include central and local government, state and municipal companies and, with higher thresholds, utilities in special sectors. Centralised purchasing organisations also buy for others. Ukraine is an EU candidate country, not a member state.[1][2][3][4]

Where tenders are published

All procedures above the thresholds run through Prozorro, the public electronic procurement system. Prozorro is a central database connected to accredited e-marketplaces (майданчики), where buyers publish and bidders register, ask questions and submit offers. Common marketplaces include Prozorro-connected platforms such as SmartTender, Zakupivli.Pro, E-Tender, Newtend and UUB Tender. Registration is done on one marketplace and gives access to all Prozorro tenders; marketplaces charge a fee for submitting an offer. Prozorro Market is the electronic catalogue for standard goods. Ukrainian bidders normally sign offers with a qualified electronic signature (КЕП). According to the Ministry of Economy and Environment, non-resident bidders registered with a foreign registration number may submit offers without a Ukrainian electronic signature by other identification methods. Ukrainian tenders are not published in TED.[8][9][10]

Procedures and thresholds

Under the Peculiarities, buyers above the thresholds use open tenders (відкриті торги з особливостями), purchases from the electronic catalogue (Prozorro Market), framework agreements or, as an exception, a negotiated procedure (переговорна процедура) on listed grounds such as a failed tender, a sole supplier or urgent need. Thresholds differ for ordinary buyers and for utilities in special sectors. Below the thresholds, buyers may use Prozorro or the catalogue but are not obliged to, and must publish a contract report for purchases above a minimum value. Splitting a contract to avoid a procedure is prohibited. Additional notices in English are required above euro thresholds set in Article 10 of the Law. Some urgent defence, energy and reconstruction purchases are exempt or follow special rules.[1][2][5][7]

Documents and language

When submitting an offer, bidders declare in the electronic system that no exclusion grounds apply (self-declaration); documents proving this are only requested from the winner, within a short deadline. The tender documentation sets the qualification criteria, for example experience, equipment, staff or financial capacity, and how to prove them. Foreign bidders may prove compliance with documents available under the law of their own country, and missing documents that do not exist there cannot be grounds for rejection. Information on ultimate beneficial owners is required. The tender documentation states the language of the offer; in practice this is usually Ukrainian, so plan for translations. Since September 2026 localisation requirements apply to certain goods, and purchases from Russia, Belarus and Iran are restricted.[2][6][8]

Deadlines, award and challenges

For open tenders under the Peculiarities the period for submitting offers is at least 15 days from publication of the notice in Prozorro. Clarification questions can be asked up to three days before the deadline. Offers are compared on price, normally through an electronic auction, or on price plus other criteria, in which case price must weigh at least 70 percent. After the buyer publishes its intention to conclude the contract, the contract may not be signed for at least five days (three in some urgent cases). Complaints go to the Antimonopoly Committee of Ukraine (Антимонопольний комітет України, AMCU) as the review body, are filed through Prozorro and require a fee. The State Audit Service (Державна аудиторська служба) monitors procurements, and civil society reviews them through DoZorro.[2][5][11][12]

How to win a tender in Ukraine

In Ukraine most tenders are decided on price, usually through an electronic auction in Prozorro. A buyer may add other criteria, such as delivery terms or warranty, but under the martial-law Peculiarities of Resolution No. 1178 price must then carry at least 70 percent, so qualification and price discipline matter more than long quality texts. Ask questions as a request for clarification in Prozorro up to three days before the deadline; the question and the answer are public in the system, and changes to the tender documentation extend the deadline. Use questions to remove discriminatory or unclear requirements, because the documentation is your contract basis. To know the buyer, study its earlier tenders, contracts, prices and competitors in Prozorro's open data and analytics and in reviews on DoZorro. Follow the qualification criteria and document list to the letter, upload a self-declaration on exclusion grounds and have translations into Ukrainian ready. Offers fail on missing or unsigned documents, wrong electronic signature, missed localisation rules or an abnormally low price you cannot justify. There is no formal debrief, but competitors' offers become visible after disclosure, and complaints go to the Antimonopoly Committee.[1][2][11][13]

  1. Check whether the tender is decided on price alone or with weighted criteria.
  2. Submit clarification requests in Prozorro at least three days before the deadline.
  3. Study the buyer's earlier tenders and prices in Prozorro and DoZorro.
  4. Prepare self-declaration, signatures and Ukrainian translations before the auction.
  5. Be ready to justify a price the system flags as abnormally low.
  6. Read the winning offer in Prozorro and decide quickly on an AMCU complaint.

Tips for bidders

Choose one accredited marketplace, register early and check how it handles non-resident accounts and fees. Read the tender documentation closely for the signature rules for non-residents, the language of the offer and the required qualification evidence, and ask clarification questions well before the deadline. Prepare a self-declaration and keep supporting documents and translations ready, because the winner has only a few days to upload them. Watch for localisation requirements in goods tenders and for procurements financed under the Ukraine Facility, where only bidders from eligible countries may take part. Use Prozorro's open data and DoZorro to study earlier contracts, prices and competitors. Keep in mind that the Peculiarities change frequently and the new law takes full effect in March 2027.[4][6][8][13]
