# How do public tenders work in Spain?

Spain buys through central government, 17 autonomous communities and thousands of municipalities, all under Ley 9/2017 (LCSP). Notices are published on each buyer's 'perfil de contratante', which for state bodies is hosted on the national Plataforma de Contratación del Sector Público (PLACSP), while several regions run their own platforms. Bids are submitted electronically, usually with an electronic signature, and in Spanish.

Checked on 15 October 2026. Made by TenderRender from official sources. Not legal advice: check the notice and documents of each tender.

## Law and buyers

Spanish public procurement is governed by Ley 9/2017 de Contratos del Sector Público (LCSP), which transposes EU directives 2014/23 and 2014/24; utilities are covered by separate legislation. Buyers include ministries and state agencies, the 17 comunidades autónomas (autonomous communities) with their own procurement rules and review bodies, provincial councils (diputaciones), municipalities, universities and public companies. The Junta Consultiva de Contratación Pública del Estado (JCCPE) at the Ministry of Finance issues guidance and manages the official bidders' register, and the independent OIReScon supervises the system. Central purchasing is done by the Dirección General de Racionalización y Centralización de la Contratación for the state, and by regional central purchasing bodies. Contracts at or above the EU thresholds are 'sujetos a regulación armonizada' (subject to harmonised rules).

## Where tenders are published

Every contracting authority must publish its tenders on its perfil de contratante (buyer profile). State bodies must host this profile on the Plataforma de Contratación del Sector Público (PLACSP), which also aggregates notices from many regional and local buyers. Catalonia, the Basque Country, Madrid and some other regions run their own platforms that feed data to PLACSP. Contracts subject to harmonised rules are also published in the EU's TED. Downloading documents is free. Submitting a bid on PLACSP is done through its free offer preparation tool and generally requires an electronic certificate to sign the bid. For the simplified open procedure, bidders must be registered in the ROLECE (official register of bidders) or have applied for registration before the bid deadline.

## Procedures and thresholds

The main procedures are the procedimiento abierto (open procedure), the procedimiento abierto simplificado (simplified open procedure, for works up to € 2.000.000 and supplies and services below the EU thresholds), an abbreviated version of the simplified procedure for small contracts, the procedimiento restringido (restricted procedure), the procedimiento con negociación (negotiated procedure, with or without publication), the diálogo competitivo and the asociación para la innovación. Very small purchases can be awarded directly as contratos menores (minor contracts) below € 40.000 for works and € 15.000 for supplies and services. Framework agreements (acuerdos marco) and dynamic purchasing systems are widely used, especially by central purchasing bodies.

## Documents and language

Applications normally include the European Single Procurement Document, called DEUC in Spanish, as a self-declaration. The winning bidder then has to prove legal capacity, solvency, tax and social security compliance, and provide a guarantee (garantía definitiva, normally 5% of the award price excluding VAT) when required. Registration in ROLECE or a regional register replaces many of these documents. For works contracts of € 500.000 or more, the contractor must hold a clasificación (official contractor classification). Foreign companies must submit a declaration accepting the jurisdiction of Spanish courts and, in general, provide documents in Spanish with an official translation; regions may also accept their co-official language.

## Deadlines, award and challenges

For open procedures subject to harmonised rules, the minimum period is 35 days from sending the notice to the EU Publications Office, which can be reduced by five days when bids are submitted electronically or to 15 days after a prior information notice. For other open procedures by public administrations the minimum is 15 days, or 26 days for works and concessions. The simplified procedure allows 15 days (20 for works), and the abbreviated version 10 working days. Contracts are awarded on the best quality-price ratio using several criteria. If the contract qualifies for the special appeal, the contract cannot be signed until 15 working days after notification of the award. The recurso especial en materia de contratación is heard by the Tribunal Administrativo Central de Recursos Contractuales (TACRC) for state contracts and by regional tribunals for regional and local contracts.

## Tips for bidders

Get an electronic certificate valid in Spain and test the PLACSP offer tool well before the deadline, since late or unsigned bids are excluded. Apply for ROLECE registration early: it takes time but lets you bid in simplified procedures and saves paperwork. Read the pliego de cláusulas administrativas particulares (PCAP) for exclusion grounds, solvency levels and the weighting of criteria, and note which part of the bid goes into which electronic envelope (sobre), since mixing price and judgement-based information can lead to exclusion. Monitor both PLACSP and the regional platform of the area you target. Use the clarification period to ask questions, as answers become part of the documents.

## How to win a tender in Spain

In Spain contracts are awarded on the best quality-price ratio (mejor relación calidad-precio), normally with several criteria set out in the pliego de cláusulas administrativas particulares (PCAP). Criteria are split into those scored automatically by formula and those that depend on a value judgement (juicio de valor), and they go into separate electronic envelopes (sobres). When judgement criteria weigh more than formula criteria, a committee of at least three experts scores them, and for intellectual services quality must carry at least 51% of the points. Ask questions early: if you request additional information at least 12 days before the deadline, the buyer must answer at least 6 days before it, and the answers become part of the tender file. Study the buyer through its perfil del contratante on PLACSP or the regional platform, its earlier awards and TED notices. Answer each judgement criterion separately, in the order and wording of the PCAP, and never put price information in the judgement envelope. Bids fail on late or unsigned electronic submission, a missing DEUC, documents in the wrong envelope and abnormally low prices (ofertas anormalmente bajas) that you cannot justify. The award must be reasoned and notified, which gives you the basis for a recurso especial.

1. Read the PCAP for criteria, weights and which envelope (sobre) each part belongs in.
2. Send questions at least 12 days before the deadline so the buyer must answer.
3. Check the buyer's perfil del contratante and earlier awards on PLACSP.
4. Answer every judgement criterion separately and keep all price data out of that envelope.
5. Submit with a valid electronic certificate well before the deadline.
6. Read the reasoned award notification and decide quickly on a recurso especial.

## Frequently asked questions

### Where are Spanish public tenders published?

On each buyer's perfil de contratante, which for state bodies is hosted on the Plataforma de Contratación del Sector Público. Some regions such as Catalonia, the Basque Country and Madrid have their own platforms, and contracts above the EU thresholds also appear on TED.

### Do I need to register to bid in Spain?

You need a free account and, in practice, an electronic certificate to sign and submit bids. Registration in ROLECE is required for the simplified open procedure and is useful for all other procedures.

### What are the thresholds in Spain?

From 1 January 2026 the EU thresholds are € 140.000 (central government) or € 216.000 (other buyers) for supplies and services and € 5.404.000 for works. Below € 40.000 for works and € 15.000 for supplies and services, a minor contract can be awarded directly.

### Can foreign companies bid in Spain?

Yes. EU companies bid on equal terms, and companies from countries in the WTO Government Procurement Agreement have access to covered contracts. Foreign bidders must accept the jurisdiction of Spanish courts.

### In which language must I bid?

In Spanish (castellano). Foreign documents generally need an official translation; some regional buyers also accept their co-official language.

### How much time do I have to submit a bid?

At least 35 days for open procedures above the EU thresholds, reducible to 30 with electronic submission. Below the thresholds the minimum is 15 days (26 for works), and 10 working days in the abbreviated simplified procedure.

### What is a contrato menor?

A minor contract below € 40.000 for works or € 15.000 for supplies and services that a buyer may award directly, with a justification report. It is published on the buyer profile afterwards.
