# How do public tenders work in Portugal?

Portugal buys through central government, the autonomous regions of the Azores and Madeira, municipalities and public companies under the Código dos Contratos Públicos (CCP), which was substantially revised from 1 October 2026. Public tenders are announced in the Diário da República (and on TED above the EU thresholds) and run on licensed private e-procurement platforms, mainly VORTAL, acinGov and anoGov. Bids are in Portuguese and signed with a qualified electronic signature.

## Law and buyers

Portuguese public procurement is governed by the Código dos Contratos Públicos (CCP), approved by Decreto-Lei 18/2008 and transposing EU directives 2014/23, 2014/24 and 2014/25. Decreto-Lei 177/2026 republished the code with effect from 1 October 2026, raising the thresholds for direct award and prior consultation, moving the simplified procedures of Lei 30/2021 into the code and applying the 'only once' principle to qualification documents. IMPIC (Instituto dos Mercados Públicos, do Imobiliário e da Construção) regulates the market and runs Portal BASE, where contracts are published. Buyers include ministries and agencies, the regional governments of the Azores and Madeira, municipalities and municipal companies, hospitals and state-owned enterprises. eSPap acts as central purchasing body for central government, and contracts above a set value need prior approval (visto) from the Tribunal de Contas.

## Where tenders are published

A concurso público (open procedure) is announced in the Diário da República, 2nd series, and above the EU thresholds also in the Official Journal of the EU (TED). Procedures are run on electronic procurement platforms licensed under Portuguese law, which are privately operated: VORTAL and acinGov handle most notices, followed by anoGov. The buyer chooses the platform, so you need an account on each platform your target buyers use; check each platform's conditions, as they also sell paid premium services such as alerts and support. Bid documents must be signed with a qualified electronic signature, which for a company usually means a qualified certificate linked to a representative with authority to bind it. Concluded contracts, including direct awards, are published on Portal BASE.

## Procedures and thresholds

The main procedures are the concurso público (open procedure), the concurso limitado por prévia qualificação (restricted procedure with pre-qualification), the procedimento de negociação (negotiated procedure), the diálogo concorrencial (competitive dialogue) and the parceria para a inovação (innovation partnership). Below set values buyers may use the consulta prévia, inviting at least three companies of their choice, or the ajuste direto, inviting a single company. From 1 October 2026 the consulta prévia is allowed below € 1.000.000 for works and € 130.000 for supplies and services, and the ajuste direto below € 150.000 and € 75.000. A buyer may not keep inviting the same company through these procedures when its cumulative awards in the current and two previous years reach those limits. Framework agreements (acordos-quadro) are common, especially through eSPap.

## Documents and language

The bid consists mainly of the technical and price proposal; in procedures published in the Official Journal of the EU the European Single Procurement Document (DEUCP in Portuguese) is also submitted. Only the winning bidder (adjudicatário) then submits qualification documents (documentos de habilitação) proving it is not in an exclusion situation, such as criminal record certificates of the company and its directors and proof of tax and social security compliance, and provides a performance guarantee (caução) when required. Under the 2026 revision, buyers must obtain information they can access themselves directly from public sources. The proposal must be written in Portuguese; the tender documents may allow certain technical documents in another language, and foreign-language documents generally need a Portuguese translation.

## Deadlines, award and challenges

For an open procedure published in the Official Journal of the EU the minimum period for bids is 30 days from sending the notice, which can drop to 15 days after a prior information notice or in justified urgency. Without EU publication the minimum is six days for supplies and services and 14 days for works (reducible to six for very simple works). Contracts are awarded to the most advantageous tender (proposta economicamente mais vantajosa), using either several weighted factors (multifator) or a single factor such as price (monofator). For procedures published in the OJEU the contract cannot be signed until 10 days after all bidders are notified of the award. Bidders can file an administrative complaint (impugnação administrativa) with the buyer and bring an urgent pre-contractual action before the administrative courts.

## Tips for bidders

Find out which platform your target buyers use and register early, including the qualified electronic signature setup, since certificate problems are a common reason for late or invalid bids. Read the programa do procedimento and caderno de encargos carefully, including the evaluation model and any minimum or maximum price (preço base). Note that the 2026 revision greatly widened direct award and prior consultation, so many contracts under € 1.000.000 for works no longer appear as open tenders; building relationships with buyers and monitoring Portal BASE for past awards helps you get invited. Prepare Portuguese translations and certificates for your directors in advance. Ask clarification questions within the first part of the bidding period, as set in the documents.

## How to win a tender in Portugal

Portuguese contracts go to the most economically advantageous tender, judged either on several weighted factors (multifator) or on a single factor such as price (monofator). The evaluation model, with its factors, sub-factors and scoring scales, is published in the programa do procedimento and applied by a jury (júri), so you can work out exactly what each answer is worth. In the first third of the bidding period you may request esclarecimentos and must also submit a list of errors and omissions you found; the answers form part of the procedure documents and prevail over them in case of conflict. Research the buyer in Portal BASE, which lists its earlier contracts and direct awards, and in Diário da República and TED notices. Write in Portuguese and answer each factor of the model with concrete figures and evidence. Bids fail on electronic signature problems, missing documents, prices above the preço base, terms that deviate from the caderno de encargos and abnormally low prices without justification. A local opportunity is the audiência prévia: the jury sends its preliminary report to all bidders, who get at least five days to respond in writing, so you can challenge scoring before the final report.

1. Score yourself against the evaluation model in the programa do procedimento.
2. Send questions and your list of errors and omissions in the first third.
3. Look up the buyer's earlier contracts and direct awards on Portal BASE.
4. Answer each factor and sub-factor in Portuguese with figures and evidence.
5. Check your qualified electronic signature and the preço base before submitting.
6. Use the audiência prévia to contest the preliminary report in writing.
