# How do public tenders work in Jordan?

Public procurement in Jordan is governed by the Government Procurement Bylaw No. 8 of 2022, with the Government Procurement Department buying supplies and services centrally and the Government Tenders Department handling works. Tenders are published and increasingly run on JONEPS, the national e-procurement system. Local tenders are reserved for Jordanian bidders, international tenders are open to foreign companies, and locally manufactured products receive a 20% price preference.

## Law and buyers

The legal basis is the Government Procurement Bylaw No. 8 of 2022 (Nizam al-Mushtarayat al-Hukumiya), amended by Bylaw No. 15 of 2022, with implementing instructions on procedures and on e-procurement. It applies to ministries, government departments, public institutions, public universities, municipalities including the Greater Amman Municipality and wholly government-owned companies. The Government Procurement Department (GPD), set up in 2019 by merging central purchasing bodies, buys supplies and services centrally, including unified medicine contracts, while the Government Tenders Department (GTD) handles works and related engineering consultancy. The Jordanian Armed Forces buy separately. Projects funded by donors may follow the donor's procurement rules, which the bylaw expressly allows. Jordan is not a party to the WTO Government Procurement Agreement.

## Where tenders are published

Tender notices are published on the electronic portal, JONEPS (Jordan Online E-Procurement System), and in any other media the responsible secretary general decides; international tenders are announced in a language suited to the place of publication. JONEPS is the main source for current tenders of the GPD, GTD and a growing number of government entities, and the GPD website points suppliers to it. Bids are submitted signed, in a sealed envelope in the tender box, by registered mail, through a representative or electronically where the documents allow, and only bidders who obtained the tender documents from the buyer may bid. JONEPS users work with electronic authentication certificates under the 2019 e-procurement instructions, so foreign suppliers should register on the system before a tender opens.

## Procedures and thresholds

Under Article 21 the default method for works and supplies is the public tender (munaqasa amma). For justified reasons the buyer may use a limited tender (munaqasa mahduda or istidraj), a two-stage tender, a request for proposals or single-source purchasing (talzim), and an electronic reverse auction can be added to any method. Consultancy services follow their own selection methods, including design contests. The bylaw distinguishes local tenders, which are restricted to Jordanian bidders, from international tenders, which are open to Jordanian and non-Jordanian bidders. Framework agreements may run for up to five years and can be closed or open to new suppliers. Purchasing committees at different levels handle contracts according to value limits set in the bylaw.

## Documents and language

The tender documents set out the technical and financial requirements, the evaluation criteria and the required qualifications; typical requirements are company registration documents, financial statements, experience and a bid guarantee, with a performance guarantee from the winner. International tender documents, the contract, specifications and correspondence are prepared in Arabic or English, and if both versions exist the Arabic text prevails. Local tender documents are in Arabic unless the buyer has a justified reason to use another language. Bids remain valid for the period in the documents, or 90 days if no period is stated. Foreign bidders should expect to legalise company documents and may find it practical to work with a Jordanian partner, which the US Commercial Service recommends.

## Deadlines, award and challenges

Article 27 sets the minimum time to submit tenders at 21 days for local tenders and 30 days for international tenders; the buyer may shorten these where necessary, provided bidders get enough time. Evaluation follows the measurable criteria in the documents, which may include technical and financial requirements, price, delivery time, operating and maintenance cost and the preference margin. In June 2026 the government announced that the Cabinet had raised the price preference for locally manufactured products in public tenders to 20%. Objections against the tender documents must be lodged within 5 working days of publication and before the submission deadline; objections against the preliminary award must be lodged within the period set by the purchasing committee. A bidder who disagrees with the buyer's decision on its objection can complain to the Procurement Complaints Review Committee within 5 working days; the committee decides within 30 working days and its decision binds the buyer.

## Tips for bidders

Check first whether a tender is local or international, because local tenders are open only to Jordanian bidders. Register on JONEPS and obtain the tender documents from the buyer in time, since only bidders holding the documents may submit. Factor in the 20% price preference for locally manufactured products when pricing goods, and consider local manufacturing or a Jordanian partner where it is relevant. Read the language clause carefully: international tenders can be in English, but the Arabic text prevails if both exist. Keep track of the short complaint deadlines, as an objection to the buyer comes first and the complaint to the review committee must follow within five working days.

## How to win a tender in Jordan

In Jordan, the Government Procurement Bylaw No. 8 of 2022 requires the tender documents to set out how technical and financial offers are submitted and the measurable evaluation criteria, which can include technical and financial requirements, price, delivery time, operating and maintenance cost and the preference margin. Where offers are split, the committee opens technical offers first and announces the evaluation results, then opens financial offers only for bidders who qualified; the others get their financial offers back unopened. So the technical offer decides whether your price is even seen. Jordanian industrial products that meet the specifications receive a 20% price preference, and local tenders are reserved for Jordanian bidders. Use requests for clarification while the tender is open: the buyer may amend the documents on its own initiative or after a bidder's request, and amendments go to everyone who obtained the documents. Bids fail when unsigned, submitted late or by someone who did not obtain the documents from the buyer, or when rejected for reasons recorded in the procurement file. Follow awards on JONEPS, keep to the short standstill of five to seven business days, and object to the buyer before complaining to the review committee.

1. Obtain the tender documents from the buyer yourself; only document holders may bid.
2. Submit requests for clarification early; amendments go to all document holders.
3. Make the technical offer complete, since financial offers open only for qualified bidders.
4. Price with the 20% preference for Jordanian industrial products in mind.
5. Object to the buyer quickly, then complain within five working days.
