# How do public tenders work in Italy?

Italy buys through central government, regions, municipalities, health authorities and public companies under the Codice dei contratti pubblici (D.Lgs. 36/2023). Since 2024 the whole procurement cycle is digital: notices are published through ANAC's national database (BDNCP) and on TED above the EU thresholds, and bids are submitted on certified e-procurement platforms such as Consip's Acquisti in Rete, regional systems and commercial platforms. Bids are in Italian and signed with a qualified digital signature.

## Law and buyers

Italian public procurement is governed by the Codice dei contratti pubblici, Decreto legislativo 36/2023, which transposes EU directives 2014/23, 2014/24 and 2014/25 and was revised by D.Lgs. 209/2024. The Autorità Nazionale Anticorruzione (ANAC) supervises the market, runs the Banca Dati Nazionale dei Contratti Pubblici (BDNCP) and qualifies contracting authorities. Buyers (stazioni appaltanti) include ministries, regions, provinces, municipalities, local health authorities (ASL) and hospitals, universities and state-owned companies. Central purchasing is strong: Consip runs national framework agreements and the MePA electronic marketplace, and regional aggregators such as ARIA (Lombardy), Intercent-ER (Emilia-Romagna), START (Tuscany) and the Lazio region buy for local bodies. Each procedure is identified by a CIG code issued through the BDNCP.

## Where tenders are published

Since 1 January 2024 tender notices acquire legal publicity through the BDNCP, via ANAC's Piattaforma Pubblicità Legale, and above the EU thresholds they are also sent to TED. Procedures must run on certified digital procurement platforms (piattaforme di approvvigionamento digitale certificate). These include Consip's Acquisti in Rete PA (including MePA), regional platforms such as Sintel, Intercent-ER, START and STELLA, and commercial platforms used by many municipalities and companies, such as TuttoGare, Maggioli Appalti, Acquisti Telematici and Net4market. Registration on the platforms is generally free, but each buyer's platform needs its own account. Bids are signed with a qualified electronic signature (firma digitale). For contracts above certain values, bidders also pay a participation fee to ANAC, set by an annual ANAC resolution.

## Procedures and thresholds

Above the EU thresholds the main procedures are the procedura aperta (open procedure), the procedura ristretta (restricted procedure), the procedura competitiva con negoziazione, the dialogo competitivo and the partenariato per l'innovazione. Below the thresholds the code allows simpler routes: affidamento diretto (direct award) below € 150.000 for works and € 140.000 for supplies and services, and procedura negoziata senza bando (negotiated procedure without a notice) with at least five operators for works from € 150.000 to € 1.000.000, at least ten operators for works from € 1.000.000 up to the EU threshold, and at least five operators for supplies and services up to the EU threshold. Buyers choose operators through market surveys or their own supplier lists (elenchi or albi fornitori), so registering on those lists matters. Framework agreements (accordi quadro) and dynamic purchasing systems are common.

## Documents and language

Bidders usually submit the European Single Procurement Document, called DGUE in Italian, together with the administrative documentation, technical offer and economic offer in separate digital envelopes. Most checks on general and special requirements are carried out by the buyer through the Fascicolo Virtuale dell'Operatore Economico (FVOE) in ANAC's database, which collects certificates such as tax compliance, criminal records and the DURC (social security compliance). A provisional guarantee (garanzia provvisoria) of normally 2% of the procedure value accompanies the bid, adjustable by the buyer between 1% and 4%. Works contractors above a set value need an SOA qualification certificate. Bids are in Italian; foreign operators can rely on equivalent documents from their country, generally with an Italian translation.

## Deadlines, award and challenges

For an open procedure the minimum time for receipt of tenders is 30 days from transmission of the notice, which can be cut to 15 days for duly motivated urgency or after a prior information notice. Contracts are awarded on the most economically advantageous tender based on the best quality-price ratio; the lowest price criterion is allowed only in limited cases. Above the EU thresholds the contract cannot be signed until 32 days after the last award notification (the standstill does not apply below the EU thresholds). Challenges are brought before the regional administrative court (TAR), with appeal to the Consiglio di Stato; the time limit for a procurement challenge is 30 days. ANAC can also issue precontentious opinions (pareri di precontenzioso) at the request of the parties.

## Tips for bidders

Set up a qualified digital signature that Italian platforms accept and register in advance on the platforms of the buyers you target; many regions and Consip each have their own. Get listed in buyers' supplier registers (albi fornitori) and on the MePA, since direct awards and negotiated procedures below the EU thresholds are drawn from them. Read the disciplinare di gara closely for envelope structure, page limits and scoring of the technical offer, and check whether a site visit (sopralluogo) is mandatory. Keep your company data up to date in the national registers so the FVOE checks run smoothly. Ask questions (chiarimenti) through the platform within the deadline stated in the documents.

## How to win a tender in Italy

Italy awards most contracts on the offerta economicamente più vantaggiosa based on the best quality-price ratio. It is mandatory for labour-intensive services and for engineering and architecture services, and in labour-intensive contracts the buyer must cap the price score at 30%. A commissione giudicatrice scores the technical offer against the criteria and sub-criteria in the disciplinare di gara, often mixing discretionary points with yes-or-no points for specific commitments. Submit chiarimenti through the e-procurement platform before the deadline in the documents; answers are published for all bidders and in practice clarify how criteria will be read. Research the buyer in ANAC's national database of public contracts, the Amministrazione trasparente section of its website, its supplier register and TED. Write in Italian, follow the structure and page limits of the disciplinare, and turn each sub-criterion into measurable commitments the commission can score. Many administrative gaps can be fixed through soccorso istruttorio, but gaps in the technical or economic offer cannot. Bids also fail on late upload, invalid digital signatures, missing site visits and abnormally low offers you cannot justify. After the award you can view the winning offer and evaluation records, and a challenge before the TAR must be filed within 30 days.

1. Check in the disciplinare whether price is capped and how points are split.
2. Send chiarimenti through the platform before the stated deadline.
3. Study the buyer's earlier awards in ANAC data and Amministrazione trasparente.
4. Turn each sub-criterion into concrete, scorable commitments within the page limit.
5. Verify digital signatures, guarantee and any mandatory sopralluogo before uploading.
6. Review the winning offer after award and decide within 30 days on a TAR challenge.

## Frequently asked questions

### Where are Italian public tenders published?

Notices get legal publicity through ANAC's national database (BDNCP) and its Piattaforma Pubblicità Legale, and on TED above the EU thresholds. The documents and submission are on the buyer's certified e-procurement platform, such as Acquisti in Rete PA, a regional system or a commercial platform.

### Do I need to register to bid in Italy?

Yes, on each e-procurement platform the buyer uses, and you need a qualified digital signature. Registration on supplier lists and the MePA is also important for smaller contracts.

### What are the thresholds in Italy?

From 1 January 2026 the EU thresholds are € 140.000 (central government) or € 216.000 (other buyers) for supplies and services and € 5.404.000 for works. Below € 150.000 for works and € 140.000 for supplies and services, buyers may award directly.

### Can foreign companies bid in Italy?

Yes. EU companies bid on equal terms and may use equivalent documents from their home country, and companies from countries in the WTO Government Procurement Agreement have access to covered contracts.

### In which language must I bid?

In Italian. Foreign documents generally need an Italian translation.

### How much time do I have to submit a bid?

At least 30 days for an open procedure, or 15 days in motivated urgency or after a prior information notice. Below the EU thresholds the buyer sets the deadline in the invitation.

### What is the garanzia provvisoria?

A provisional guarantee submitted with the bid, normally 2% of the procedure value, which the buyer may set between 1% and 4%. It can be a deposit or a bank or insurance guarantee.
