# How do public tenders work in France?

France buys through central government, regions, departments and municipalities and public bodies such as hospitals, under the Code de la commande publique. Notices from € 90.000 (works from € 100.000) appear in BOAMP or a legal announcements journal, larger contracts also on TED, and bids are submitted electronically on the buyer's own 'profil d'acheteur' platform. Bids must be in French.

## Law and buyers

French public procurement is governed by the Code de la commande publique (CCP), which transposes the EU directives 2014/23, 2014/24 and 2014/25. The Direction des Affaires Juridiques (DAJ) of the Ministry of Economy publishes guidance and standard forms. Buyers include central government ministries, the regions, departments and municipalities (collectivités territoriales), hospitals and public companies. Central purchasing bodies play a big role: UGAP is the national general-purpose purchasing centre, the Direction des achats de l'État (DAE) steers state purchasing, and sector bodies such as RESAH and UniHA buy for hospitals. A contract below the EU thresholds is a 'marché à procédure adaptée' (MAPA) with flexible rules; above them a formalised procedure applies.

## Where tenders are published

The official journal for procurement notices is the BOAMP. From € 90.000 for supplies and services and € 100.000 for works, a notice must appear in BOAMP or in a legal announcements journal (JAL), and above the EU thresholds in BOAMP and on TED. The documents and the bid submission sit on the buyer's 'profil d'acheteur', a dematerialised platform. The state uses PLACE (marches-publics.gouv.fr); local and regional buyers use public platforms such as Maximilien (Île-de-France) or commercial ones such as AWS-Achat (marches-publics.info), achatpublic.com, e-marchespublics.com and Marchés Sécurisés. Registration on these platforms is normally free. A qualified electronic signature is generally not needed at submission; the winning bidder signs the contract at award, often electronically.

## Procedures and thresholds

Above the EU thresholds the formalised procedures are the appel d'offres ouvert (open procedure), the appel d'offres restreint (restricted procedure), the procédure avec négociation, the dialogue compétitif and the partenariat d'innovation. Below them, buyers use the procédure adaptée (MAPA), where they set their own rules for advertising and negotiation as long as they respect equal treatment and transparency. Very small purchases may be awarded without advertising or competition: below € 100.000 for works and, from 1 April 2026, below € 60.000 for supplies and services. Framework agreements are common and are called accords-cadres, executed through bons de commande (orders) or marchés subséquents (mini-competitions).

## Documents and language

At the application stage you can use the European Single Procurement Document (DUME in French) or the national forms DC1 (lettre de candidature) and DC2 (déclaration du candidat); a buyer may not reject a DUME. The application also contains evidence of capacity as asked in the règlement de consultation, such as turnover, references and certificates. The winning bidder must then provide proof of tax and social compliance, usually through form NOTI2 or an attestation de régularité fiscale and an URSSAF attestation de vigilance, plus a Kbis extract or foreign equivalent. Bids and supporting documents must be in French or accompanied by a French translation; foreign companies can provide equivalent documents from their home country.

## Deadlines, award and challenges

For an open procedure above the EU thresholds, the minimum period for receiving bids is 35 days from sending the notice, and it can be shortened, for instance when bids are submitted electronically or a prior information notice was published. Under a MAPA the buyer sets a 'reasonable' deadline. Contracts are awarded to the most economically advantageous tender, usually a mix of price and quality criteria with weightings stated in advance. Unsuccessful bidders must be informed of the reasons, and above the EU thresholds there is a standstill period of 11 days when notification is electronic (16 days otherwise). Bidders can challenge a procedure before signature through a référé précontractuel at the tribunal administratif, and after signature through a référé contractuel or a contract action.

## Tips for bidders

Read the règlement de consultation (RC) closely, because it sets the required documents, evaluation criteria and weighting, and the platform to use. Create an account on the buyer's profile before the deadline and test the upload; late electronic bids are rejected. Use the DUME to reuse company data across procedures. Ask questions through the platform within the deadline stated in the RC, since answers are shared with all candidates. For small contracts, monitor regional platforms and the buyer's own profile, because MAPAs below € 90.000 may only be advertised there. Foreign bidders should plan French translations of technical offers and prepare equivalent tax and social certificates early.

## How to win a tender in France

Under the Code de la commande publique the contract goes to the most economically advantageous tender, assessed on criteria linked to the subject of the contract; Article R2152-7 allows qualitative, environmental and social criteria alongside price. The règlement de consultation (RC) sets the criteria, subcriteria and weightings, and quality is usually judged on the mémoire technique, so structure it exactly along the RC and make it specific to this buyer. Ask questions through the buyer's profile within the deadline in the RC; in formal procedures the buyer must send the additional information at least six days before the bid deadline, and answers go to all candidates. To know the buyer, use BOAMP and TED award notices, the essential data of concluded contracts published as open data on data.gouv.fr and the buyer's deliberations. Bids fail when they arrive late on the platform, are incomplete or irregular, or contain an abnormally low price that you cannot justify under R2152-3; Use the DUME and reply in French. After rejection you can ask for the reasons and, for a formal procedure, the characteristics and relative advantages of the winning bid and its name; use them to improve your mémoire technique.

1. Map the RC criteria, subcriteria and weightings onto your mémoire technique outline.
2. Study the buyer's past awards on BOAMP, TED and data.gouv.fr essential data.
3. Ask questions on the buyer profile early so answers arrive six days before deadline.
4. Write a buyer-specific mémoire technique with means, method, staff and planning.
5. Check DUME, signatures and price breakdown, then upload well before the deadline.
6. Request the reasons and the winner's relative advantages after rejection.
